Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cosmicly, including our website, app experiences, accounts, astrology content, chat features, rituals, courses, and related services (collectively, the "Service"). The Service is operated by AICOFI PTE. LTD. ("AICOFI", "we", "us", or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Cosmicly. If you are under the age of majority in your location, you may use the Service only with the involvement and consent of a parent or legal guardian.

2. Entertainment and self-reflection only

Cosmicly provides astrology, horoscope, compatibility, ritual, spiritual wellness, and self-reflection content for entertainment and personal insight. The Service is not medical, mental health, legal, financial, investment, safety, or other licensed professional advice. You should not rely on the Service as a substitute for qualified professional advice or emergency support.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, keep it reasonably current, and notify us promptly if you suspect unauthorized access.

4. Birth data and personalization

Some features rely on birth date, birth time, birth place, preferences, and user-provided prompts. You are responsible for the accuracy of information you provide. Readings and generated insights may be incomplete, symbolic, automated, or interpretive.

5. User content

You retain ownership of content you submit, such as profile details, prompts, messages, feedback, and support requests. You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, transmit, and use that content as needed to provide, secure, support, and improve the Service.

You represent that you have the rights needed to submit your content and that it does not violate these Terms or the rights of others.

6. Acceptable use

You agree not to:

  • use the Service for unlawful, harmful, deceptive, or abusive activity;
  • harass, threaten, exploit, or harm another person;
  • submit content that infringes intellectual property or privacy rights;
  • attempt to bypass security, rate limits, access controls, or paywalls;
  • copy, scrape, crawl, or extract data except as permitted by law;
  • reverse engineer, interfere with, or disrupt the Service;
  • resell, sublicense, or commercially exploit the Service without permission;
  • use the Service to make high-stakes decisions about health, finance, law, employment, housing, insurance, or safety.

7. Purchases, subscriptions, and refunds

Some features may require payment or a subscription. Prices, features, billing periods, promotions, and availability may change. Taxes may apply. When payments are enabled, payment processing may be handled by a third-party provider subject to its own terms and privacy policy.

Unless otherwise stated at checkout or required by law, purchases are final and fees are non-refundable. Subscription cancellations normally take effect at the end of the current billing period.

8. Intellectual property

Cosmicly, the Service, logos, visual assets, software, text, designs, workflows, and other materials are owned by AICOFI or our licensors and are protected by intellectual property laws. These Terms do not transfer ownership of the Service or our content to you.

9. Third-party services

The Service may use or link to third-party services, including hosting, authentication, database, payment, communications, analytics, or content providers. We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.

10. Beta, demo, and availability

Some features may be experimental, in demo mode, temporarily unavailable, or subject to change. We may modify, suspend, or discontinue any part of the Service at any time.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for the Service or other users, or used the Service unlawfully. After termination, provisions that by their nature should survive will remain in effect.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

13. Limitation of liability

To the fullest extent permitted by law, AICOFI and its officers, directors, employees, contractors, agents, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption.

To the fullest extent permitted by law, our total liability for claims relating to the Service will not exceed the greater of the amount you paid to us for the Service in the three months before the event giving rise to the claim or SGD 100.

14. Indemnity

You agree to indemnify and hold harmless AICOFI and its officers, directors, employees, contractors, agents, affiliates, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

15. Governing law and disputes

These Terms are governed by the laws of Singapore, without regard to conflict of law rules. Subject to any mandatory rights you have under local law, the courts of Singapore will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.

16. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you. Continued use of the Service after updated Terms take effect means you accept the updated Terms.
